University of the Rockies Privacy Policy

At University of the Rockies, we take your personal privacy seriously. This document describes the categories of information we gather via the website and for what purpose, outlines how that information may be shared with others, and identifies the categories of persons with whom it may be shared. By registering with University of the Rockies or by using the University of the Rockies Site, you accept and agree to this Privacy Policy and the University of the Rockies Terms and Conditions of Usage.

This Privacy Policy applies to the Internet website of University of the Rockies at www.rockies.edu. This Privacy Policy also applies to other affiliated websites that are owned by University of the Rockies and made available to students in the matriculation process and after they have enrolled with University of the Rockies; and the Rockies Mobile application. All such sites will be collectively referred to in this Privacy Policy as the "University of the Rockies Site" or "Site".

This Privacy Policy does not apply to information collected at any site that is not owned by University of the Rockies, including any website reached through a link on any University of the Rockies Site. By way of example only, a link on University of the Rockies Site takes a viewer to an online bookstore that is owned and operated by EdMap, not University of the Rockies. The name and logo of University of the Rockies may appear on that online bookstore website in order to notify students that the bookstore sells certain materials specified for University of the Rockies' curriculum. University of the Rockies does not have access to information collected through that online bookstore. This Privacy Policy does not apply to information collected through that online bookstore. FERPA

The Family Educational Rights and Privacy Act ("FERPA") and our own FERPA compliance policy govern the educational records of University of the Rockies students. This Privacy Policy, and, to the extent applicable, FERPA govern the collection and use of information through the University of the Rockies Site. Please note that FERPA is applicable to information you provide only if you are or become a student of University of the Rockies.

FERPA permits the disclosure of "directory information." University of the Rockies may use and disclose directory information that you provide, in the manner provided by this Privacy Policy for the use and sharing of personally identifiable information. "Directory information" means your name, address, telephone listing, date and place of birth, major field of study, participation in officially recognized activities, dates of attendance, degrees and awards received, and the most recent previous educational agency or institution you attended. If you do not want such information about you to be disclosed, please contact us at student.records@rockies.edu. Please note that you may opt out of disclosure of this information only if you are now or become a student of University of the Rockies.

How does University of the Rockies use and share personal information?

We may use and share your personal information in the following ways:

  1. We may use your personal information to contact you or send newsletters, updates and/or special offers to you, and may share this information with contractors that help us to contact you.
  2. We will use your personal information to determine your student status during the enrollment process and may share this information with governmental authorities and their contractors, with degree-granting institutions and teaching certificate granting institutions and their contractors, and with our contractors that help us to communicate with such governmental agencies, institutions and their contractors.
  3. We may provide your personal information to our affiliated schools, including Ashford University, if the information you provide indicates to us that its programs or classes may be of interest to you.
  4. We may share your personal information with companies and individuals that provide support services to us, such as contractors that send e-mails or direct mail for University of the Rockies, maintain or update mailing lists, analyze data, provide marketing/sales assistance, provide customer service for the Site, or carry out other duties relating to the operation of our Site.
  5. We may use and share your personal information with governmental authorities, other educational institutions and their contractors to comply with FERPA reporting regulations, or as otherwise permitted or required by FERPA.
  6. We may use and share your personal information with third parties and governmental agencies to comply with a legal requirement or court order.
  7. We may use and share your personal information to work with partner firms to reduce fraud risk.
  8. We may use your personal information to protect the rights, property or safety of University of the Rockies, our users, other students in our classes, employees, contractors or agents or others and would thereby share your information with such parties.
  9. We may use your personal information to enforce our terms of service.
  10. We might sell or buy websites, divisions, companies or assets or merge with other companies, and your personal information may be among the business assets transferred to or shared with the persons or entities involved in such sales or purchases.

By using the University of the Rockies Site, you understand and agree that we may use and share the personal information that you provide in these ways.

University of the Rockies's practices regarding cookies and other information University of the Rockies collects on this Site?

Your browser software has a feature called a 'cookie' that stores small amounts of data on your computer about your visit to certain websites. As a user of browser software, you may elect to disable this feature, although doing so may prevent you from using certain features that require cookies. Cookies placed on your computer by University of the Rockies generally don't provide University of the Rockies with any personally identifiable information about you, but instead provide anonymous information that permits University of the Rockies to track how users navigate our pages, when users return to our sites, and which features are the most popular. We collect that information using cookies, and we use it to analyze how our Site is used. We may share that information with other persons or entities who assist us in analyzing or operating the Site.

Like many commercial websites, University of the Rockies’ servers monitor and log all web traffic on the Site. These logs contain the IP address of the computer or server that you are using to access the Site, the IP address and/or the URL from the website you visited just before you visited our Site, the URL of the page you visit upon leaving the Site, if any, and the type of browser and operating system you are using. Statistical information is collected about visitor traffic patterns in order to improve the quality, functionality and usefulness of the Site to our customers. In such cases, the system has no means to identify you personally. We may also create and maintain records of data collected from cookies and demographic information that has been aggregated from multiple personally identifiable records such that it is no longer personally identifiable with a particular person (for example, the aggregate number of inquiries from a particular city, state or zip code). We may share all of the data described above with our contractors and consultants, other educational institutions, and unaffiliated third parties such as analysts, reporters, governmental authorities and others. We may also share the content of the logs described above in response to a court order, subpoena, or other legal process.

Please know that while some browsers allow you to send a signal indicating that you do not wish to be "tracked", our Site does not recognize or respond to these “Do Not Track” signals.

Use of Flash Cookies, Third-Party Cookies and HTML5

Our Site may enable the use of the Adobe Flash Player. Adobe’s Flash Player is used by the vast majority of websites that offer video and other interactive content. By default, your use of the Adobe Flash Player generates “flash cookies” (also known as “persistent identification elements” or “local shared objects”). Adobe provides a short disclosure about Flash Cookies in its End User License Agreement, stating “Use of the web players, specifically the Flash Player, will enable the Software to store certain user settings as a local shared object on our computer. These settings are not associated with you, but allow you to configure certain settings within the Flash Player.” The Adobe Flash Player (and similar applications) use flash cookies to remember user settings, preferences and usage in a manner similar to the browser cookies referenced above. However, flash cookies can store more information than browser cookies and are managed through a different interface than the one provided by your web browser. You can control the degree to which you accept flash cookies using tools in the settings manager for Adobe Flash (http://www.macromedia.com/support/documentation/en/flashplayer/help/settings_manager.html). (Users running the Windows operating system can generally view flash cookie files in this folder: \Documents and Settings\[username]\Application Data\Macromedia\Flash Player. Users running the Apple operating system can generally view flash cookie files in this folder: /users/[username]/Library/Preferences/macromedia/Flash Player. Flash cookies, or LSO files are stored typically with an “.SOL” extension.) If you do not allow flash cookies on your computer, you may not be able to take advantage of certain features of the Site.

HTML is the software language used for building most of the sites on the World Wide Web. Almost all web pages you visit on the Internet are built using HTML code. HTML5 is simply the fifth and latest iteration of this language. HTML5 is a popular standard for presenting content, especially content delivered to mobile devices. Some HTML5 code may allow your responses to advertising and your other online activities to be monitored over time and across different web sites, and for such information to be stored on your computer or mobile device and accessed by others you do or have done business with. Solutions that allow users to opt-out of or block this sort of tracking are being developed through browser add-ons and other tools. University of the Rockies may access user activity information stored through this feature of HTML5

Additionally, like many other companies, University of the Rockies may use third parties to help monitor user visits to this Site and/or to place advertisements or links on other websites. When you visit this Site, these companies may collect non-personally identifiable information (e.g., your IP address, click stream information, browser type, time and date, subject of advertisements clicked or scrolled over) about your visits to this Site and your visits to other websites over time. These companies typically use a cookie or third party web beacon to collect this information about your online activities over time and across different web sites, and may use this information to provide advertisements about goods and services likely to be of interest to you. Special considerations for students enrolled with University of the Rockies

If you are enrolled in online classes you participate in your courses by actively engaging in online class discussion forums and education sessions. Please understand that any information that is disclosed during an online classroom experience, in the Rockies Café, or in an Ask Your Instructor discussion board becomes known to others in the class and to University of the Rockies and its employees and contractors, such as instructors and administrators. We have no control over information exchanged during these online sessions, you should have no expectation that content you post will be private, and you should exercise caution when deciding to disclose your personal information or any other information about yourself or others. The information presented during an online education session reflects the views of the individual users or instructors and does not necessarily reflect the views of University of the Rockies or any of its affiliates.

University of the Rockies may maintain records of information you post to class discussion forums, written communications you make to professors, and written assignments, papers and exam responses you submit to fulfill class or degree requirements (“your content”). The Family Educational Rights and Privacy Act ("FERPA") and University of the Rockies’s FERPA compliance policy govern the educational records of University of the Rockies students. For the full FERPA policy, including which records are governed by the policy, please refer to the University of the Rockies Academic Catalog. University of the Rockies’ use of your content is also governed by the University of the Rockies Terms and Conditions of Usage, which you accepted and agreed to by using the Site. Other than the content you post to class discussion forums and the Rockies Café and Ask Your Instructor discussion boards, it is not University of the Rockies’ policy to share your content except as permitted or required under FERPA and except as University of the Rockies deems necessary to enforce University of the Rockies’ policy on academic integrity.

In the course of enforcing University of the Rockies’ policy on academic integrity, employees of University of the Rockies may submit your written assignments to a service designed to ensure originality and detect plagiarism. By enrolling as a student at University of the Rockies and participating in classes or otherwise meeting degree requirements, you consent to the submission of your written assignments to such services, in accordance with their terms of use and privacy policies. In particular, you consent to their retention of copies of your written assignments in order to ensure that others do not plagiarize your work.

How does University of the Rockies protect personal information?

Although we cannot guarantee against any loss, misuse, unauthorized disclosure, alternation or destruction of data, we try to prevent such occurrences. Our servers and databases are protected by firewalls and passwords. In addition, we use Secure Sockets Layer (SSL) software to encrypt data as it travels between your computer and our servers.

You are responsible for helping to keep your student account secure. You should use appropriate and reasonable practices to keep your account access credentials (including your username, password, and any other names, numbers, or codes used to access resources on or through the Site) secure and never share your account access credentials, including your password with anyone else. Another person who has access to your account access credentials and password may be able to view your personal information, make changes to your personal information or post information and comments to class discussion forums as if that person were you.

Children

We do not ever knowingly collect information from children under the age of 18, nor is this Site designed to provide any service to children under the age of 18. If you are under 18, please do not give us any personal information. If you have reason to believe that a child has provided personal information to us, please contact us at contact@rockies.edu and we will attempt to remove that information from our databases.

Consent to international data processing

This Site is operated in the United States. By providing any information to University of the Rockies, all users, including, without limitation, users in the member states of the European Union, Canada or elsewhere outside of the United States, represent that they fully understand and consent to this Privacy Policy. University of the Rockies may transfer your personal information to our contractors located in the United States, Mexico and other countries for the purposes and under the conditions described in this Privacy Policy. By using our Site, participating in any of our services and/or providing us with your information, you consent to the collection, transfer, storage and processing of your information to and in the United States, Mexico or any other country in the world. In addition, you waive any restrictions on such collection, transfer, or storage of your information imposed by the laws of any country other than the United States.

Changes to this Privacy Policy

We reserve the right, in our sole discretion, to add to, change, update or modify this Privacy Policy, in whole or in part, at any time. When we amend this Privacy Policy, we will revise the effective date located at the beginning of this Privacy Policy. For changes to this Privacy Policy that we consider to be material, we will place a notice on the University of the Rockies website (www.rockies.edu) by revising the link on the homepage to read substantially as “UPDATED Privacy Policy” for a reasonable amount of time. By providing information to us or using the Site in any way after this Privacy Policy has been revised, you consent and agree to the revised Privacy Policy. The most current version of this Privacy Policy will be available on the Site and will supersede all previous versions of this Privacy Policy. The effective date of the current version of this Privacy Policy is listed at the beginning of the Privacy Policy. 

Conditions of use

This Privacy Policy shall be governed by and construed in accordance with the laws of the State of California, United States of America. By using our Site, you consent to the collection and use of information described above. Your visit and any dispute over privacy are subject to this Privacy Policy and our Terms and Conditions of Usage. If you have any concern about privacy related to the University of the Rockies Site, please e-mail us a thorough description together with information to permit us to contact you, and we will try to resolve your concern.

Links to other sites

The Site may contain now or in the future links to other websites, such as links to online bookstores, degree-granting institutions, teaching certificate institutions, and third parties that may provide services or products to you. We are not responsible for the privacy practices, the content of, or any other actions of such other websites or their owners or operators, such as their practices regarding cookies, information they may collect or information they may share, or whether they may permit advertisers to place and use cookies. You should check the privacy policies at each of those sites.

Requesting changes to your information

If you wish to review and request changes to your personal information that we collect through the Site, you may contact us directly. If you want to request us not to send you emails, you may make that request by sending us an email at student.records@rockies.edu. If you are enrolled with University of the Rockies, you may also access your personal profile, request changes to your personal information, and request that we not send you emails by logging onto the Rockies Student Portal and selecting the "My Information" option.
